How Long Does a Divorce Take in Texas?
Texas law requires in almost all cases that divorcing couples wait a minimum of 60 days before a divorce is finalized. However, the reality is that most divorces take a considerably longer time to finalize, depending on factors such as complexity of the estate or children. Cases with multiple contested issues that need to be litigated can take months or even years to resolve, though the parties can also choose to go to mediation before proceeding to trial.
The 60-day waiting period may be waived under the following circumstances:
- If your spouse has been convicted of or received deferred adjudication for a crime involving family violence against you or a member of your household or
- If you have an active protective order or an active magistrate’s order for emergency protection against your spouse because of family violence during your marriage.
A parenting plan must be established that is in the best interest of the child with terms for visitation, addressing the rights and duties of the parents and any other issues that affect the children. Parents often disagree about school districts, extracurriculars activities, and other factors that play a role in child custody arrangements. The court must consider the best interest of the child over all other interests and will not simply move forward without resolving issues in the best interest of the children for the sake of expediency.
